Executive answers
The monthly deadline is the 15th, and the test is about payment, not intent. Contributions for a wage month are payable by the 15th of the following month under Paragraph 38 of the Employees' Provident Funds Scheme, 1952, through the Electronic Challan cum Return (ECR) on the EPFO Unified Portal. March wages are due by 15 April. Do not plan around a grace period, and do not wait for the 15th to generate the ECR: payment must be credited against a valid Transaction Reference Number (TRRN) on or before the due date, so build the internal deadline at the 10th to 12th.
Default triggers three separate monetary levies, and they stack.
- Interest under Section 7Q of the EPF Act at 12 per cent per annum on the delayed amount, from the due date to the date of payment.
- Damages under Section 14B, levied by the Regional PF Commissioner after notice. Paragraph 32A of the Scheme sets the rates by period of delay: 5 per cent per annum for delay under two months, 10 per cent for two to four months, 15 per cent for four to six months, and 25 per cent beyond six months, capped at the arrears. The Supreme Court has held that mens rea and mitigating circumstances are relevant to the quantum of damages (Horticulture Experiment Station, Gonikoppal v. Regional Provident Fund Organisation, 2022), but the authority applies the schedule as the starting point.
- Determination of dues under Section 7A, where EPFO inquires into non-coverage, short coverage, a narrow wage base, or non-remittance, issues a summons, and passes an order. Appeal lies to the Employees' Provident Fund Appellate Tribunal under Section 7I, subject to a statutory pre-deposit under Section 7O (40 per cent of the amount determined at the time of writing).
Personal and leadership exposure is real. Deduction of the employee's share from wages without deposit is the most serious default. Section 14(1A) provides imprisonment (for a term that can be up to three years, with a statutory minimum in the case of employee contribution deducted and not paid) and a fine, and Section 14A extends liability to every person in charge of and responsible for the conduct of the company's business. EPFO also initiates recovery under Sections 8B to 8G (attachment of bank accounts and property), and prosecutions routinely add criminal breach of trust charges under the Bharatiya Nyaya Sanhita, 2023. Signing authorities, HR heads and finance controllers who approve payroll are within the exposure.
Under-deduction is the employer's cost. Under Section 30 of the EPF Act, the employee's contribution can be recovered only from wages of the month to which it relates, and the employer's contribution cannot be recovered from the employee. A month's under-deduction cannot be corrected by deducting more later, and the shortfall falls on the establishment.
Zero-tolerance reconciliation means zero variance, not a tolerance band. The payroll register, the attendance record and the ECR must agree on member count, wages, contribution and non-contributory days, line by line, to the rupee, before payment. Every variance needs a named explanation and a sign-off.
Scope and applicability
Establishment coverage
- Threshold: The EPF Act applies to every establishment in a scheduled industry or class of establishment employing 20 or more persons (Section 1(3)). The Central Government can extend coverage to establishments with fewer persons, and an employer and the majority of employees can opt in voluntarily (Section 1(4)).
- Who counts as an employee: Section 2(f) includes any person employed, directly or through a contractor, in or in connection with the work of the establishment, on wages. Contract workers count toward the 20-person threshold and are covered members.
- Coverage date: The establishment is covered from the day it reaches the threshold, not the day it registers. Late registration produces arrears, interest and damages for the gap.
- Permanence: Once covered, the Act continues to apply to the establishment even if headcount later falls below 20.
- Exempted establishments: Establishments with an approved private provident fund trust (Section 17) manage their own trust, but still follow the Act's rules on rates and file returns. Verify the exemption status and its conditions.
- Contribution rate: 12 per cent of PF wages for most establishments. A reduced rate of 10 per cent applies to establishments with fewer than 20 employees that are covered voluntarily or notified, and to specified classes. Confirm the rate on the establishment's coverage record.
Wage ceiling triggers
The statutory wage ceiling is ₹15,000 per month of PF wages. It operates in five different ways, and payroll must apply each correctly.
| Application | Rule |
|---|---|
| Mandatory coverage | An employee with PF wages up to ₹15,000 at joining must be enrolled. |
| Excluded employee (Paragraph 2(f) of the Scheme) | A new joiner who is not already a member of the EPF or the EPS and whose PF wages exceed ₹15,000 at joining need not be enrolled. Enrolment is by joint option of the employer and the employee. |
| Contribution base | The employer may contribute on a capped base of ₹15,000, or, by joint option, on the actual PF wages (Paragraph 26(6) of the Scheme). The choice must be consistent across the establishment's covered members, as the EPFO's guidance and the establishment's practice require, and documented. |
| EPS (pension) wages | The pension share of 8.33 per cent is computed on wages up to ₹15,000, so the maximum monthly pension contribution is ₹1,250. Contribution on wages above the ceiling is available only to members who exercised the higher pension option under the Supreme Court's judgment in EPFO v. Sunil Kumar B. (2022) and the EPFO's implementing circulars. |
| EDLI wages | The EDLI contribution of 0.5 per cent is computed on wages up to ₹15,000, with a maximum of ₹75 per member per month. |
Age. Pension contribution ceases at age 58. For members over 58, the employer's entire 12 per cent goes to the EPF account, and EPS wages and contribution are reported as nil.
Worked examples (12 per cent, rounded to the nearest rupee):
| PF wage | Base | Employee 12% | EPS 8.33% (on up to ₹15,000) | EPF employer 3.67% (balance) | EDLI 0.5% (on up to ₹15,000) |
|---|---|---|---|---|---|
| ₹12,000 | Actual | ₹1,440 | ₹1,000 | ₹440 | ₹60 |
| ₹15,000 | Actual or capped | ₹1,800 | ₹1,250 | ₹550 | ₹75 |
| ₹20,000 | Capped at ₹15,000 | ₹1,800 | ₹1,250 | ₹550 | ₹75 |
| ₹20,000 | Actual | ₹2,400 | ₹1,250 | ₹1,150 | ₹75 |
The EPFO administrative charge is 0.5 per cent of PF wages, subject to the prescribed minimum per establishment. EDLI administrative charges are not separately levied at present. Verify the current rates in the circular in force.
Actual basic versus the ceiling
A frequent payroll error is testing the ₹15,000 ceiling on the wrong number. The test applies to PF wages, which means basic wages, dearness allowance and retaining allowance as defined in Section 2(b), after the wage definition adjustments below, and not to gross salary and not to a payroll head labelled Basic. Where a salary structure has a low Basic and a large Special Allowance, the Supreme Court's decision in Regional Provident Fund Commissioner v. Vivekananda Vidya Mandir (2019) holds that allowances paid universally, necessarily and ordinarily to all employees, and not linked to extra work or special conditions, form part of basic wages. A structure designed to keep PF wages below ₹15,000 is exposed to a Section 7A inquiry.
The 50 per cent wage rule under the Codes
Under the Code on Wages, 2019 and the Code on Social Security, 2020, wages means basic pay, dearness allowance and retaining allowance. Allowances and other components excluded from wages (such as house rent allowance, conveyance, overtime, commission, bonus, employer's PF contribution and gratuity) are added back to wages to the extent they exceed 50 per cent of total remuneration. Example: total remuneration ₹1,00,000, basic and DA ₹30,000, excluded components ₹70,000. Wages for the Code's purposes are ₹50,000, because excluded components cannot exceed ₹50,000. The consequences for PF are:
- The PF wage floor for each employee is 50 per cent of total remuneration, before the ceiling election.
- An employee on a low Basic and a high gross may no longer qualify as an employee with wages up to ₹15,000, which affects mandatory coverage and the excluded-employee analysis.
- Employers who contribute on the capped base of ₹15,000 are less affected, but must still classify employees correctly at joining and test coverage.
Model payroll under both the existing definition and the Code definition, record the policy adopted, and follow EPFO's transitional instructions.
International Workers
An International Worker (IW) is an Indian employee who is working or has worked outside India, or a foreign national employed in a covered establishment in India, as defined in Paragraph 83 of the Scheme. For IWs the ₹15,000 wage ceiling does not apply, and contributions are payable on full wages (12 per cent each from employer and employee), with the pension component treated under Paragraph 83 and the EPS provisions. Foreign nationals from countries with which India has a Social Security Agreement may claim exemption through a Certificate of Coverage, which must be held on file and reflected in the ECR through the appropriate IW and exemption fields. Verify the current EPFO instructions, because IW treatment, the reporting fields and the withdrawal rules differ from those for resident members.
Detailed guide
Onboarding and KYC control
The aim is that no employee enters the first payroll without an active, verified UAN.
- Form 11 (Declaration Form). Collect at joining. It records previous membership of the EPF or EPS, previous UAN, date of exit from the earlier establishment, and any international worker status. It determines whether the employee is an existing member (for the ceiling and the excluded employee test) and prevents duplicate UANs. Retain the signed form in the employee file. It does not replace the online record.
- UAN. Each person has one UAN for life. If the employee has a UAN from a previous employer, use it and link it to your establishment. If not, generate a UAN through the Employer's portal (member registration), and share it with the employee. Never generate a second UAN for an existing member, because duplicates block transfers and claims.
- KYC seeding. Seed and verify the UAN with the Aadhaar, PAN and bank account (account number and IFSC), and the mobile number. EPFO has made Aadhaar verification of the UAN a condition for ECR filing and for benefits under related schemes, so confirm Aadhaar seeding as part of onboarding and follow the current circular. The employer approves KYC documents on the Unified Portal where the member has uploaded them.
- UAN activation. The member activates the UAN on the Unified Member Portal or the UMANG app. Confirm activation before the first month-end, because the member's access to passbooks, claims and transfers depends on it.
- Name, date of birth and gender in the payroll master must match the Aadhaar. Mismatches are the commonest source of ECR and claim errors.
- Date of joining in the establishment, and the previous employer's date of exit, must be consistent with the Form 11, since a gap or overlap blocks transfer of the account.
- Gate rule: payroll does not run PF deduction for an employee whose UAN is not generated, Aadhaar-seeded and linked to the establishment. Hold the employee on a pending-KYC list with a dated action, but deduct and remit the contribution from the coverage date once the UAN is active, so that no month is skipped.
Wage definition and split mechanics
PF wages: Basic + dearness allowance + retaining allowance (Section 2(b)), plus any allowance that meets the test of being universally, necessarily and ordinarily paid (Vivekananda Vidya Mandir), with the Code's 50 per cent rule applied once in force. Exclusions under the existing Act include house rent allowance, overtime, bonus and commission, and similar allowances, and the employer's own contribution. Paid leave and holiday wages, and wages for the days the employee is on duty, are within wages.
Computation, in order:
- Compute PF wages for the month on earned wages after loss of pay. Contribution is on wages actually earned, so a loss-of-pay month reduces the base, and the days appear as non-contributory days (NCP) in the ECR.
- Apply the establishment's wage base election (capped at ₹15,000 or actual) consistently, and document any joint options.
- Employee share: 12 per cent of PF wages (or the voluntary higher rate, see VPF).
- Employer share of 12 per cent, split as: 8.33 per cent to the EPS (Account 10) on EPS wages (the lower of PF wages and ₹15,000, unless a higher pension option applies), and the balance, 3.67 per cent on the capped base, to the EPF (Account 01). Where PF wages exceed ₹15,000 and contribution is on actual wages, the EPF employer share is 12 per cent of PF wages less the EPS amount.
- EDLI (Account 21): 0.5 per cent of EDLI wages (the lower of PF wages and ₹15,000), payable by the employer.
- Administrative charges (Account 02): 0.5 per cent of PF wages, subject to the minimum.
- Rounding: Contributions are rounded to the nearest rupee (50 paise and above rounded up), and the employer's share must be computed on the same basis. Fix the rounding rule in payroll so that ECR values do not differ by a rupee.
- Arrears and back-dated wage revisions: Contribution is due on the arrears. Report them through a supplementary ECR for the relevant wage month, and note that late payment attracts interest and damages from the original due date.
- Members over 58: EPS wages and EPS contribution nil, with the full employer share to EPF.
Contribution accounts: Account 01 (EPF, employee and employer share), Account 10 (EPS), Account 21 (EDLI), Account 02 (administrative charges). The challan must show each head separately.
Data reconciliation protocols
Pre-payroll cross-verification (before the payroll lock):
- Attendance and muster roll to the payroll input: days worked, paid leave, loss of pay, joiners and leavers, and unpaid periods. The loss-of-pay days become NCP days.
- New joiner list to UAN master: every joiner has an active, KYC-seeded UAN, a Form 11, and the correct date of joining.
- Leaver list to exit entries: every leaver has a date of exit and a reason code ready for the portal.
- Wage revisions, arrears, special allowances and structure changes tested against the PF wage definition.
- Contract workers and international workers flagged and routed to the correct treatment.
ECR draft reconciliation (before payment):
- ECR member count equals the active covered headcount, plus joiners, less leavers, with a roll-forward from the previous month.
- Line-by-line comparison of UAN, name, gross wages, EPF wages, EPS wages, EDLI wages, employee share, EPS share, EPF employer share and NCP days against the payroll register. Total contributions equal the payroll deduction ledger.
- Gross wages in the ECR agree with the gross salary register, and EPF wages agree with the PF wage computation. Gross-to-net and ECR line items must tie.
- Rounding, member age checks for EPS, and wage ceiling tests applied to every line.
- Variances reported, explained and signed by payroll and finance before the TRRN is generated.
Joint declarations. The Joint Declaration (JD) process on the Unified Portal corrects a member's profile data (name, date of birth, gender, father or spouse name, date of joining, nationality) with the employer and the member jointly confirming and supporting documents attached. Small corrections can be approved by the employer, and larger changes (for example, a date of birth correction beyond the limit that EPFO prescribes) need the Regional Office's approval. Use JD to fix mismatches before a claim, and not to solve a mismatch by creating a new UAN. A separate joint option between employer and member is used for contribution on wages above ₹15,000 and for the higher pension option. Keep both on file.
Exits and the date of leaving. Mark the date of exit and the reason (resignation, termination, retirement, death, transfer) on the Unified Portal for every leaver, promptly after the exit, and not later than the month following, as the establishment's process. Without an exit date the member cannot transfer or withdraw, the new employer's linking is blocked or flagged, and the account shows overlapping membership. Match the date of exit to the last contribution month. The employer should not mark an exit for an employee who is on leave of absence but not separated.
Remittance, ECR and portal validation
- ECR content. For each member, the ECR file carries the UAN, member name, gross wages, EPF wages, EPS wages, EDLI wages, EPF contribution (employee share), EPS contribution, EPF employer share (difference), NCP days and refund of advances, with the wage month. Validate the file in the portal's pre-check, correct errors, and upload it.
- Challan generation and payment. After a successful upload, generate the combined challan with the TRRN, and pay through the authorised bank channels before the TRRN lapses. Payment is matched to the TRRN, so a payment against the wrong TRRN, an expired TRRN or a wrong establishment will not match. Keep the bank confirmation.
- Return status. The ECR is treated as filed when the payment is confirmed against the TRRN. Confirm the status and download the ECR, the challan and the payment receipt. Do not assume completion from the bank debit.
- Account statements. Download the establishment's monthly statement and compare the contribution credited to the challan.
- Notices. Monitor the portal and the registered email for notices under Sections 7A and 14B, and diary every response date.
Contractor PF validation
Where contract workers work in the establishment, the principal employer is liable in the first instance for the contributions and administrative charges under Section 8A, and may recover from the contractor. Each month, obtain the contractor's ECR with the TRRN, the challan and the payment confirmation, reconcile the member list and wages to the billed headcount and the muster roll, check that every worker has an active, Aadhaar-seeded UAN, and confirm the wage base and the due date. Reject a compliance certificate in place of these documents. The Vendor & Contractor Labour Compliance Audit Checklist sets out the full procedure.

Common mistakes
- Deducting PF without verifying an active UAN and KYC. The deduction runs in payroll for a joiner whose UAN is not generated, not Aadhaar-seeded or not linked to the establishment, and the ECR line is rejected or left out. Consequence: the employee's share is deducted but not remitted for that month, which engages Section 14(1A) exposure, interest under Section 7Q and damages under Section 14B once the contribution is paid late, and the employee's account shows a gap.
- Mismatching the gross-to-net register with the ECR line items. The ECR carries gross wages, EPF wages and EPS wages that do not tie to the payroll register, because of arrears, mid-month structure changes or manual edits. Consequence: a short-paid wage base is a prime trigger for a Section 7A inquiry, with arrears for all months in the look-back, interest and damages.
- Missing date-of-leaving updates. Leavers are not marked as exited on the portal. Consequence: the member's transfer and withdrawal claims are blocked, the new employer's linking is flagged for overlapping membership, the old establishment keeps showing the person as active, and members escalate to the Regional Office, which draws scrutiny to the establishment's records.
- Delayed ECR generation. Payroll closes late, the ECR is generated on the 14th, and a rejection, a TRRN problem or a bank cut-off pushes payment past the 15th. Consequence: interest at 12 per cent per annum under Section 7Q for the delay, and damages under Section 14B on the Paragraph 32A schedule. Damages are levied even for a delay of a day, subject to the authority's assessment of the circumstances.
- Paying against the wrong TRRN or an expired TRRN. Consequence: the payment sits unmatched, the ECR shows as unpaid, and the due date passes with money in the bank's pool account. Delay is computed from the due date to the date the payment is matched.
- Testing the ₹15,000 ceiling on the Basic head instead of PF wages. A structure with a low Basic and a large Special Allowance keeps wages under the ceiling on paper. Consequence: a Section 7A determination under Vivekananda Vidya Mandir, with arrears on the allowance for every month and employee in the period, plus interest and damages.
- Mixing wage base elections. Some employees are contributed on the capped base and others on actual wages without documented joint options. Consequence: EPFO treats the whole establishment as contributing on actual wages in an inquiry, and computes the differential.
- Treating the employee's share as recoverable later. Under-deduction in one month is corrected by deducting more in the next. Consequence: Section 30 does not permit it, so the shortfall is the employer's cost.
- Creating a second UAN for a rejoining or transferring employee. Consequence: duplicate accounts, blocked transfers, split service history and rework for the employee and the establishment.
- Excluding contract workers from coverage counts and from vendor checks. Consequence: the principal employer carries Section 8A liability for the contractor's default, and the headcount used to test coverage is understated.
- Ignoring EPFO notices. The notice goes to an unattended email or a former address and the hearing date lapses. Consequence: an ex parte order under Section 7A, with recovery action under Section 8B onward, including attachment of bank accounts, and an appeal that needs a pre-deposit.
- No audit trail. Form 11, KYC records, registers, ECR files and receipts are not retained in a retrievable form. Consequence: the establishment cannot rebut a Section 7A claim or show diligence in a Section 14B proceeding.
Action Plan: Four-Phase Monthly Operational Workflow
Run this cycle every month, with named owners and dated sign-offs. Dates assume payment by the 12th, to leave three days of margin before the statutory deadline.
Phase 1: Pre-Payroll Lock (before payroll processing)
- Freeze inputs. Close attendance, loss of pay, joiners, leavers, transfers, wage revisions, arrears and allowances for the month at a fixed cut-off.
- KYC gate for joiners. Confirm each joiner has a UAN, Aadhaar-seeded, PAN and bank details verified, Form 11 on file and the UAN linked to the establishment. Escalate open cases with a dated action.
- Exit register. Confirm date of exit and reason for every leaver, and prepare the portal entries.
- Wage base review. Check pay head mapping for new allowances, structure changes and promotions. Test employees near the ₹15,000 ceiling, members turning 58, and any international worker.
- Contract workers. Confirm vendor headcount for the month and prepare the vendor document requests.
- Lock and sign. The payroll lead signs the lock note. Changes after the lock go through a controlled change log.
Phase 2: ECR Draft Generation and Reconciliation
- Generate the ECR draft from the locked payroll, using the fixed rounding rule.
- Run the member count roll-forward: opening members, plus joiners, less leavers, equals closing members, matched to the draft.
- Reconcile line by line: UAN, name, gross wages, EPF wages, EPS wages, EDLI wages, employee share, EPS share, employer EPF share and NCP days against the payroll register. Reconcile the totals to the payroll deduction ledger and to the expected contribution by account.
- Explain variances. Each variance has a cause, an owner and a decision (correct in payroll, correct in ECR, or carry to the arrear ECR). Finance reviews and signs.
- Pre-validate on the portal. Upload to the pre-check, clear errors such as invalid UANs, Aadhaar or name mismatches and date inconsistencies, and re-run.
- Clear the pending-KYC and mismatch lists through joint declarations or member action, without creating duplicate UANs.
Phase 3: Remittance and Portal Challan Validation
- Generate the combined challan and TRRN on the signed ECR, by the internal date (the 10th to 12th).
- Check the challan against the reconciled totals for each account: 01, 10, 21 and 02, and the total payable.
- Pay through the authorised bank channel with maker and checker approval, within the TRRN validity.
- Validate the status. Confirm that the payment is matched to the TRRN and the ECR shows as filed. Chase any unmatched payment with the bank and the EPFO helpdesk the same day, with the evidence.
- Download the ECR, the challan and the payment receipt.
- Mark exits on the portal for the month's leavers, and file any supplementary ECR for arrears.
Phase 4: Post-Payment Archival and Audit Trail
- Archive the monthly pack by establishment code and wage month: payroll register, attendance summary, reconciliation sheet with sign-offs, ECR file, challan, receipt and the portal statement.
- Reconcile the portal passbook for a sample of members, and the establishment's account statement.
- Collect contractor proofs (ECR, TRRN, challan, payment confirmation), reconcile to the vendor invoice and release payment only on verification.
- Update the notice register and track every EPFO notice, response, hearing and appeal date.
- Run the monthly exception report: members without Aadhaar seeding, duplicate UANs, leavers without exit dates, ECR variances and interest or damages paid. Report to the HR Director and the Finance Controller.
- Quarterly: a sample audit of wage base, KYC, rounding and exits by someone outside the payroll team, and an annual review of the wage definition policy against the Code and EPFO circulars.
Frequently asked questions
VPF is an extra employee contribution above the statutory 12 per cent, elected in writing. The employer need not add to it. In the ECR, report the total employee deduction (12 per cent plus VPF) in the employee share, and leave the EPS and employer shares at the statutory computation. Apply changes prospectively, and remit VPF by the same 15th deadline. Interest above ₹2.5 lakh a year is taxable.
Compare the payroll master, Form 11, Aadhaar and UAN profile to find the source. If the UAN profile is wrong, raise a Joint Declaration with supporting documents; larger date-of-birth changes need Regional Office approval. If Aadhaar is wrong, the member corrects it with UIDAI first. Never generate a new UAN to bypass a mismatch, and do not skip the remittance while the correction is pending.
Take the stages in order. If the upload fails, read the error report: invalid UANs, Aadhaar or name mismatches, wage field errors or a duplicate return. If the ECR shows unpaid, check the TRRN, the establishment and the bank's confirmation, and raise an EPFO grievance with evidence. Near the due date, write to the Regional Office. Do not generate a second TRRN and pay twice.
Do not accept a certificate. Each month, obtain each contractor's ECR with TRRN and member list, the challan and payment confirmation, and reconcile them to the invoice and muster roll. Check that UANs match, every worker has an active UAN, the wage base is not below minimum wage and payment was on time. Under Section 8A you pay first if the contractor defaults, so withhold payment without proof.
Log the notice and the hearing date on the day it arrives, and do not let it lapse. Identify the scope: the period, the allegation (non-coverage, short wage base, late payment, or non-remittance) and the amount. Collect the ECRs, challans, registers, wage structure and the evidence of the reason for any delay. File a written reply before the hearing, attend through an authorised representative, and request the computation sheet.
